Montana Jury Awards $850,000 in Aluminum Bat Lawsuit

    I wonder what the impact will be on the bat industry.
    Although this is baseball, the same applies to softball.
    Look for:
    Bat prices to increase due to increased liability insurance.
    Government owned ball parks to ban the bats.
    Who knows what else.

    As much as I hate what happened to the young man and his family and would not want to face this myself. This is still a sport and the parents send their kids onto the field knowing the dangers. Bat companies now have all the 2000, 2004 and 2008 stamps on the bats and have lowered the "POP OFF THE BAT" speeds. Again I really hurt for this family. You know, I would bet that more kids die from riding with their parents while the parent is talking on a cell phone going to the ball field, than a child getting hit in the head with a hit ball on the field. Who's at fault then? The cell phone company or the car manufacture. JMO

    Wow !!

    I really can't believe that a jury found a bat company in violation of not putting adequate warning on a bat for mph rating..all I can say is wow. I got one better than that ,where I use to live a family tried to sue NC DOT because there son's car didn't handle a road very well while he exceeded 100 mph on a curvey road. He flipped and was killed ,wow you think it might have been because he was going to fast ??:willy_nilly:

    There is an inherent danger in the sport of softball and baseball. And everyone that plays the game or allow their kids to play should know that. But there has to be limitations for safety sake.

    I believe that the efforts being made to create composite bats with the same characteristics as wood bats is going to alleviate much of the danger that is common in today's games.

    The game does not have to be unnecessarily dangerous to be exciting.

    though i agree there is an inherent danger that is known before you step on the field, i believe that some thought has to be directed at the bat manufactures. some have purposely tried, with success, to violate the top bpa speeds on bats....all in pursuit of having the rep of making the "hottest" bat and the chase of the almight dollar. bpa's are set to protect the infielder, they know that and should produce a product that falls within those guidelines AFTER the breakin period is over, not before it begins.

    way too many teams are "rolling" bats or purchasing them prerolled, as access to them is relatively easy. but i doubt that anyone who has done this has given any thought to what happens if their dd caves someones face in, in part, due to an altered or "hot" bat.

    i dont agree with the juries verdict, unless you can prove that the bat exceeded the guidelines it was supposed to be made under.

    i would however, like to see some of these people who make a living rolling bats or try to sidestep the guidelines ncaa/asa has set on manuf. bats to be held responsible for their actions, if in fact it lead to an injury or death.

    a freak death is one thing, but to increase the chances of this occuring is totally wrong.......give me a wood bat, i can still hit em over with those...

    Has anyone priced a GOOD/HQ wood bat lately? Compairing what the offset from breaking/replacing a wood bat to a Comp or Alu bat???? Just curious

    Aluminum bats should be banned ...period!

    The argument made for allowing the bats in the first place was simply a financial one. That certainly is not the case any more.

    Aluminum bats have made a travesty of the game. If the long ball is what everyone wants than turn the baseball into a super ball---at least no one will die when struck. We've had 8 kids in NC this past HS, summer, and fall season have to go to the hospital for major surgery from struck balls using aluminum bats. There were no injuries from struck balls in the summer collegiate league (wood bat only) or the summer wood bat tournaments.

    I can not believe there is a logical argument for the use of aluminum bats.

    I've seen some hard hit balls off wood bats,and come to think of it why isn't there a warning on wood bats about possible splitting that might go through somebody's chest or other parts of their body when the trade mark is held incorrectly and the bat breaks ?? You see where this lawsuit is going, cheap wood to cut cost........:beatdeadhorse5::bouncer:------------------- Guru

    There has been concern about the maples bats and the way it breaks..composite bats are now illegal to use in college baseball. My problem is not with a kid being able to hit a ball squarely and hard with a wood bat; it's when the bat does all the work...and not the player. I watched a kid 130 lbs dripping wet go yard this summer. When he had to use a wood bat this summer, he was over matched. Aluminum bats is not baseball, it's cyber ball.

    As far as using an aluminum bat in softball, I don't have an opinion simply because I haven't seen enough of it. But what I have seen on TV---with the shorter field and closeness to the pitcher, some of those DD's can flat out hit--thank god it's not a missile like a baseball can be.
